The following agreement regards your legal rights in using and subscribing to the Clickup service. Please read it carefully. We may occasionally update this policy and the most updated version of our privacy policy will always be posted in our website. If you continue to use Clickup after these changes are posted, you agree to the revised policy.



  1. 1. Introduction

Thank you for choosing to use Clickup (“Clickup”, “we”, “us”, “our”). By signing up or otherwise using the Clickup service, websites, and software applications (together, the “Clickup Service” and “Service”), or accessing any content or material that is made available by Clickup through the Service (the “Content”) you are entering into a bidding contract with the Clickup entity indicated at the bottom of this document. In this Privacy Policy references to “you” means any person submitting any data to us, to the website or the Clickup Service about himself, herself or itself. This Privacy Policy sets out the way in which we may use such information.

Our Privacy Policy is governed by and interpreted in accordance with the applicable laws of the Commonwealth of Puerto Rico. The user agrees to use the Clickup Service in accordance with the Constitution of the Commonwealth of Puerto Rico, applicable laws, rules or regulations of use published on the Service.
 

  1. 2. Personal Information

We may collect Personal Information from users in a variety of ways, including, but not limited to, when users use our Service, place an order, fill out a form, and in connection with other activities, services, features, or resources we make available on our websites. When we use the term “Personal Information” in this policy, it means any information that could potentially be used to identify an individual, such as name, surnames, email address, and phone number. We will collect Personal Information from users if they voluntarily submit such information to us. Users can always refuse to supply Personal Information and may contact us to remove their Personal Information from out database.
 

  1. 3. Merchants

  1. As a Merchant, you agree to post a privacy policy on your storefront that complies with the laws applicable to your business. You also agree to obtain consent from your customers for the use and access of their Personal Information by Clickup and other third parties. In addition, if you are collecting any sensitive Personal Information from your customers, you agree to obtain affirmative, express consent from your customers for the use and access of sensitive Personal Information by Clickup and other third parties.
     

  1. 3a. The Personal Information We Collect from Merchants

We collect your name, company name, address, email address, phone number(s), and credit card details. We use this information to provide you with our Services; for example, to confirm your identity, contact you, and invoice you.

We collect data about the webpages hosted by Clickup that you visit. We may collect data about how and when you access your account, including information about the device and browser you use, your network connection, and your IP address. We will use this information to give you access to and improve our Services.

We collect Personal Information about your customers that you share with us or that customers provide while shopping or during checkout. We use this information to provide you with our Services and so that you can process orders and better serve your customers.

We collect Personal Information when you sign up for our Services, when you access our Services or otherwise provide us with the information.

  1. 3b. The Personal Information We Collect from Merchant’s Customers

We collect our merchant’s customers’ name, email, shipping, and billing address, payment details, company name, phone number, IP address, and device data, which could include location.

We need this information to provide merchants with our Services, including supporting and processing orders, authentication, and processing payments. We also use this information to improve our Services.

We collect this information when a merchant’s customer uses or accesses our Services, such as when a customer visits a merchant’s site or places an order.
 

  1. 4. Information from Clickup website visitors

We collect information about the device and browser you use, your network connection and your IP address. We may also receive Personal Information when you purchase items or make other requests to Clickup via any of our websites.

We collect this information when you visit Clickup-hosted pages or engage with us via email or web form. We also collect any additional information that you might provide us.
 

  1. 5. Online Tracking

Clickup tracks its customers over time and across third party websites to provide targeted Services and therefore does not respond to Do No Track (DNT) signals. When you arrive at or leave the Clickup website, we automatically receive the web address of the site that you came from or are going to. We also collect information on which pages of our website or Clickup-hosted merchants’ website you visit, IP addresses, the type of browser you use and the times you access our website.
 

  1. 6. Cookies, Web Beacons, Local Storage, and Similar Technologies

When you access our website, or use our Services, we (including companies we work with) may place small data files on your computer or other device. These data files may be cookies, pixel tags, or other local storage provided by your browser or associated applications (collectively “Cookies”). We use Cookies to recognize you as a customer, customize our Services, content and advertising, measure promotional effectiveness, help ensure that your web security is not compromised, mitigate risk and prevent fraud, and to promote trust and safety across our sites and Services.

You are free to decline our Cookies if your browser or browser add-on permits. However, declining our Cookies may interfere with your use of our website and Services.

  1. The data that we collect from you may be transferred to and stored at our databases. It may also be processed by for us or for one of our suppliers, partners, advertisers, and affiliates.     We follow industry standards on information security management to safeguard sensitive information, such financial information or any other Personal Information entrusted to us. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee the absolute security of your Personal Information.

We may pass your Personal Information to our agents, subcontractors, and merchants to help us with any of our uses of your data set out in our Privacy Policy. We may use third parties to assist us to deliver products to you, analyze data and to provide marketing.

We may transfer your data to other companies in our group of participating vendors or merchants. Please be aware that these third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and our Services and welcome any feedback about these sites.

We may transfer our databases containing your personal information if we sell, or discuss the sale of, our business, or part of it to an actual or potential purchaser.

We may also disclose your details as described elsewhere in this Privacy Policy.
 

  1. 9. User-Generated Content from Merchants

Clickup may post, upload, and/or contribute (“post”) content to the Service (which may include, for example, text, pictures, information, and other types of content) (“User Content”). To be clear, “User Content” includes any such content that you upload to social media or third party and you have authorized Clickup to promote it or integrate it in its Service.
 

  1. 10. Your Rights

You have the right to ask us not to process your personal data, to provide information to you (whether by email or otherwise) or marketing information about Products advertised on the Services. However, changing asking us to not process your personal data or to provide you information of our Services may inhibit your ability to the use of our Services, so we do not recommend that you do this.

The Services may, from time to time, contain links to and from the websites or mobile applications of third party suppliers, merchants, advertisers, and affiliates. If you follow the link to any of those websites or mobile applications, please note that those websites and mobile applications have their own privacy policies and that we do not accept any responsibility or liability for those policies. Please check those privacy policies before you submit any personal data to those websites or mobile applications.
 

  1. 11. Privacy Policy Changes

We may update this policy from time to time. If we believe that the changes are material, we will let you know by doing one of the following procedures: (a) sending you an email or message about the changes or (b) posting the changes on the Clickup website. We will let you know of the changes so you can decide whether you want to continue using the Services. By reading this privacy policy and your continued use of our Services, you acknowledge that you have reviewed the Privacy Policy and you have accepted to the use of the Services under the updated policy.
